Refund, Cancellations and Returns Policy

Overview

This Refund, Cancellations and Returns Policy ("Policy") explains the terms and conditions regarding subscription cancellations, refunds, and account termination for Recon Rev services provided by Recon Rev Pty Ltd ("we," "our," or "us").

As Recon Rev is a digital software platform providing vehicle reconditioning management services, this policy does not cover physical product returns, as no physical goods are sold through our platform.

Subscription Plans and Billing

Monthly Subscription Tiers

Recon Rev offers three monthly subscription tiers, with each tier enabling more vehicles and sales staff to be added to your account.

Billing Cycle

All subscriptions are billed monthly in advance. Your subscription will automatically renew each month unless cancelled. Billing occurs on the same date each month as your initial subscription date.

No Free Trials

Recon Rev does not offer free trial periods. Full subscription fees apply from the date of account activation.

No Setup or Onboarding Fees

There are no additional setup, onboarding, or activation fees beyond your monthly subscription cost.

Cancellation Policy

How to Cancel

You may cancel your subscription at any time by:

No Advance Notice Required

You may cancel your subscription at any time without providing advance notice. However, we appreciate early notification to ensure a smooth transition and address any concerns you may have.

Effective Date of Cancellation

Cancellations become effective at the end of your current billing cycle. You will retain full access to all features and services until the end of the period you have already paid for.

No Automatic Renewal After Cancellation

Once cancelled, your subscription will not automatically renew, and no further charges will be applied to your payment method.

Refund Policy

General Refund Policy

Due to the nature of our digital software services and immediate access to platform features upon subscription, refunds are generally not provided for monthly subscription fees once the billing period has commenced.

Exceptional Circumstances

Refunds may be considered in the following exceptional circumstances:

  • Billing Errors: Unauthorized or incorrect charges
  • Technical Failures: Significant service outages lasting more than 48 hours
  • Account Access Issues: Inability to access services due to technical problems on our end
  • Duplicate Payments: Accidental multiple charges for the same billing period

Refund Calculation

When refunds are approved under exceptional circumstances, they will be calculated on a pro-rated basis for the unused portion of your current billing period from the date the issue occurred or was reported.

Refund Processing

Approved refunds will be processed within 7-10 business days and credited to the original payment method used for the subscription. Bank processing times may vary and are beyond our control.

Subscription Downgrades

If you downgrade from a higher-tier subscription to a lower-tier subscription, the change will take effect at the start of your next billing cycle. No partial refunds are provided for downgrades within the same billing period.

Data Retention and Account Closure

Data Access During Paid Period

Following cancellation, you will retain full access to your account data, vehicle information, and historical records until the end of your paid billing period.

Data Retention Policy

After your subscription ends, we will:

  • Immediate: Disable access to the platform and mobile applications
  • 30 Days: Maintain your data in case you wish to reactivate your account
  • 6 Months: Permanently delete all personal and business data from our systems

Data Export

Before your subscription ends, you may request an export of your data including vehicle records, inspection reports, and other account information. Data export requests must be made before the end of your billing period.

Reactivation

You may reactivate your account within 30 days of cancellation by contacting our support team. After 30 days, you will need to create a new account, and historical data cannot be recovered.

Account Suspension and Termination

Payment Failure

If payment for your monthly subscription fails, your account will be suspended after a 5-day grace period. Suspended accounts are locked out of the platform, but your data remains secure during the suspension period.

Involuntary Termination

We reserve the right to terminate accounts for:

  • Violation of our Terms and Conditions
  • Fraudulent or illegal activities
  • Abuse of platform features or resources
  • Non-payment after suspension period

No Refunds for Policy Violations

Accounts terminated for policy violations are not eligible for refunds of any kind, regardless of the remaining billing period.

Dispute Resolution

Dispute Escalation

If a dispute cannot be resolved through customer support, you may escalate the matter through formal dispute resolution processes in accordance with South African consumer protection laws.

Consumer Rights

Consumer Protection Act

This policy is designed to comply with the South African Consumer Protection Act 68 of 2008. Nothing in this policy limits your rights under applicable South African consumer protection legislation.

Unfair Practices

You have the right to report any unfair business practices to the National Consumer Commission if you believe your consumer rights have been violated.

Tier Changes and Upgrades

Upgrading Your Subscription

You may upgrade to a higher-tier subscription at any time. Upgrades take effect immediately, and you will be charged the pro-rated difference for the remainder of your current billing cycle.

Downgrading Your Subscription

Downgrades to lower-tier subscriptions take effect at the start of your next billing cycle. Your account will maintain current-tier features until the end of the paid period.

Feature Limitations

If your usage exceeds the limits of a lower-tier subscription, you may need to upgrade or remove excess data before the downgrade can take effect.

Force Majeure and Service Interruptions

Uncontrollable Circumstances

We are not liable for service interruptions caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet service provider issues, or third-party service failures.

Planned Maintenance

Scheduled maintenance and updates that may temporarily interrupt service are not grounds for refunds unless they significantly exceed announced timeframes.

Changes to This Policy

We reserve the right to modify this policy at any time. Changes will be communicated through our platform or via email, and the updated policy will be posted on our website with a new effective date.

Continued use of our services after policy changes constitutes acceptance of the updated terms.
